Access to your health records (Data Protection Act 1998)
How can I see my records?
- We aim to work in partnership with you, by sharing plans for your care and information written in your health records, as part of day to day practice.
- You can ask the health professional you see, to show your records to you and explain anything which is unclear.
What if I want formal access?
- Under the Data Protection Act 1998 section (7) you have a right to access and make copies of your health records.
- You will need to complete a form, which your health professional can get for you. Please ask us if you would like help with filling it in.
- If you are requesting records for a deceased person, you will need to provide legal evidence (Access to Health Records Act 1990).

How long will I have to wait to see my records?
- The Trust has up to 40 days from the date your application is received, to provide you with access to your health records.
- The health professional responsible for your care will be happy to make an appointment to go through the records with you.
Will I have to pay to see my records?
- No, if you have been seen by the health professional within the last 40 days, there is no charge. If this is not the case, the Trust will charge an access fee between £10 and £50 maximum.
What if I think my records are inaccurate?
- Under the Data Protection Act (1998) all information held on you must be accurate. If this is not the case, you will need to raise it with your health professional or write to the Trust.
- The Trust will help to amend errors, which will be jointly agreed and signed.
- If there is any disagreement about the accuracy of your records you have the right to seek legal advice.
